Pre Arrest

Additional Information

Eww…..blue lights behind me!

Eww…two police at the door!

That sinking feeling just set in. You might know what it’s about and then again you might not.

When you encounter a law enforcement officer and you haven’t called for one, the officer will usually be doing one of two things, investigating a violation of the law or effectuating an arrest. Here are a few things you do need to know.  The first thing to know is that you do not, and likely should not, give the officer any more information than required by law – your name, address, and date of birth.

You must produce identification for an officer if demanded, which leads me to my second point – if an officer gives you an option to deny any type of information or request, you should deny that information or request.

  • For example, if an officer says, “you don’t mind if I search your car, do you?” your answer is “yes, I do mind.”

  • When the officer then asks why you mind, the answer is a simple, “I prefer not to consent to anything or answer any questions officer, it is my right and I am exercising it.”

If an officer has stopped you, found an arrestable offense for which he/she did not arrest you, and let you go with the understanding you need to call them, you should reach out to

Remington Law Firm, PLLC for a consultation immediately. 336-226-8887

If an officer wants to talk to you, don’t do it without an attorney; not at home, not at a police station, not on the side of the road! Get the officer's number and call the experienced attorneys at Remington  Law Firm, PLLC to speak with us first.
