Murder is the intentional, unlawful taking of a human life with malice. 

The difference between first-degree and second-degree murder is the premeditation and deliberation, a process that North Carolina case law has said can be as short as a momentary thought. 

Felony murder is when a person is killed in the commission of a predicate felony. 

If someone is involved in a drug deal and someone gets killed, the person doing the killing can, and likely will, be indicted for murder. Likewise if a person is killed in a robbery, kidnapping etc. 

Felony murder is treated in the law as first degree murder and requires life imprisonment without the possibility of parole, but could result in the death penalty.

 Felony assaults usually involve the use of a weapon with the intent to kill or inflict serious injury or the infliction of serious bodily injury, a condition that is either permanent or causes great physical injury. 

These assaults have been covered heavily in the law and are very well defined but are still largely up to the jury as to whether the injuries in any case meet that criteria. Any assault on a law enforcement officer that results in a cut or bruising is a felony.
